Terms of Service

Last modified: October 14, 2026•Platform: Profylixiume

Effective Date: 10/27/2026

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Profylixiume, concerning your access to and use of the Profylixiume platform, website, and related digital services. By accessing or utilizing any part of the service, you acknowledge that you have read, understood, and agreed to be bound by all of these terms. If you do not agree with all of these legal provisions, you are expressly prohibited from using the platform and must discontinue use immediately.

2. Description of Services

Profylixiume provides access to specialized web-based service solutions, workflow efficiency tools, digital analytical resources, and related technical functionality. The specific specifications, features, and capabilities of the offerings may vary depending on the tier, configuration, or ongoing technological updates implemented by Profylixiume. Profylixiume reserves the continuous right to modify, enhance, restrict, or discontinue any feature, tool, or component of the service at any time without prior liability to you.

3. User Eligibility and Account Obligations

To access certain features of the service, you may be required to register for an account. By creating an account or accessing the service, you represent and warrant that:

  • You are of legal age and possess the legal capacity to enter into binding agreements in your applicable jurisdiction.
  • All registration details, information, and documentation you submit are truthful, accurate, complete, and current.
  • You will maintain the security and confidentiality of your credentials and accept sole responsibility for all activities that occur under your account.
  • Your utilization of the service does not violate any applicable domestic or international law, statute, or regulation.

Profylixiume retains the unrestricted right to suspend or terminate accounts, reclaim usernames, or cancel service permissions if any provided information is discovered to be inaccurate, misleading, fraudulent, or in breach of these terms.

4. Acceptable Use and Prohibited Activities

You may not access or use the platform for any purpose other than that for which Profylixiume makes the service available. As an express condition of use, you agree that you will not:

  • Systematically retrieve data or content from the service to compile, directly or indirectly, a collection, database, or directory without written authorization.
  • Circumvent, disable, or interfere with security-related components, authentication systems, or access-prevention controls.
  • Engage in unauthorized framing of or linking to the service, or deploy automated bots, scrapers, or scripts.
  • Use the service to transmit malicious payloads, trojans, worms, cancelbots, or harmful code designed to disrupt server performance.
  • Decompile, reverse engineer, disassemble, or derive the underlying source code of any proprietary software forming part of the platform.
  • Employ the service for competitive benchmarking, unlawful marketing practices, deceptive actions, or activities contrary to applicable advertising standards.
  • Harass, threaten, defame, abuse, or infringe upon the legal rights of other users or personnel of Profylixiume.

5. Intellectual Property and Proprietary Rights

Unless otherwise explicitly indicated, the platform, source code, databases, operational functionality, software architecture, audio, video, text, imagery, and graphical assets, as well as the trademarks, service marks, and trade dress associated with Profylixiume, are owned or licensed by Profylixiume and are protected under relevant copyright, trademark, and proprietary property rights. Subject to your strict compliance with these terms, Profylixiume grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for internal operational or personal purposes.

6. Service Availability and Modifications

Profylixiume endeavors to maintain continuous platform accessibility; however, operational interruptions, system upgrades, network latency, or hardware failures may occur. Profylixiume cannot guarantee uninterrupted or error-free access and shall have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the platform during any downtime, maintenance period, or discontinuance of services.

7. Disclaimer of Warranties

The service is provided on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, Profylixiume explicitly disclaims all warranties of any kind, whether express, statutory, or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and title.

Profylixiume makes no warranties or representations regarding the precision, completeness, or reliability of any content, analysis, or recommendation available through the platform. Profylixiume assumes no responsibility for any errors, defects, unauthorized server incursions, or technical interruptions resulting from third-party networks or software dependencies.

8. Limitation of Liability

To the fullest extent authorized under governing law, in no event shall Profylixiume, its directors, officers, employees, affiliates, or agents be liable to you or any third party for any direct, indirect, incidental, consequential, exemplary, special, or punitive damages, including lost revenue, lost profits, loss of operational data, or intangible business interruptions arising out of or related to your use of, or inability to use, the platform.

Notwithstanding anything to the contrary contained herein, the aggregate liability of Profylixiume to you for any cause whatsoever, and regardless of the form of the action, shall at all times be limited to the amount paid, if any, by you to Profylixiume during the three-month period immediately preceding the event giving rise to liability, or fifty United States dollars, whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless Profylixiume, its subsidiaries, corporate affiliates, officers, contractors, and employees from and against any claims, losses, liabilities, demands, judgments, costs, and legal fees asserted by any third party resulting from or arising out of: (a) your use of the service; (b) your breach or alleged violation of these terms; (c) your violation of any legal rights of another party, including intellectual property or privacy rights; or (d) any harmful act directed against other service users with whom you interacted through the service.

10. Dispute Resolution, Binding Arbitration, and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these terms, the breach thereof, or the platform shall be settled by binding individual arbitration administered by an established, independent arbitration provider in accordance with its commercial dispute rules. Judgment on the award rendered by the arbitrator may be entered in any court possessing competent jurisdiction.

You and Profylixiume mutually agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or consolidated legal action. You expressly waive any right to trial by jury.

11. Governing Law and Legal Jurisdiction

These terms, along with any disputes arising out of their construction or performance, shall be governed by, construed, and enforced strictly in accordance with the substantive laws applicable to domestic commercial contracts, excluding conflicts of law principles. If any dispute proceeds before a court rather than arbitration, the parties consent to the exclusive jurisdiction and venue of the courts situated within the territory where Profylixiume manages its principal operational administration.

12. Severability and Enforceability

If any clause, section, or provision of these terms is deemed unlawful, void, or unenforceable by an arbitrator or court of competent jurisdiction, that specific provision shall be deemed severable and shall not affect the validity, legality, or enforceability of any remaining provisions, which shall continue in full force and effect.

13. Entire Agreement and Waiver

These terms constitute the entire, definitive agreement and understanding between you and Profylixiume regarding your access to and use of the platform, superseding all prior oral or written negotiations, arrangements, or understandings. The failure of Profylixiume to exercise or enforce any statutory or contractual right under these terms shall not operate as a waiver of such right or provision.
